These Terms of Service (“Terms”) govern your use of the ig.cr platform and related services (the “Platform”) operated by KDC Tek Pvt. Ltd. (“KDC,” “we,” “us,” or “our”). By accessing or using the Platform, you agree to be bound by these Terms.

1. Platform Description

The Platform provides tools for connecting, managing, and automating Instagram Business and Creator accounts via the official Instagram Graph API. Features include Instagram media synchronization, comment and direct message management, automation flows, content publishing, and WooCommerce integration. Each user is provisioned a dedicated site within the Platform.

2. Eligibility

You must be at least 18 years old and have the legal capacity to enter into these Terms. You must have a valid Instagram Business or Creator account to use the Platform’s core features.

3. Account Responsibilities

You are responsible for maintaining the security of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use. KDC is not liable for any loss arising from unauthorized access to your account.

4. Instagram API and Meta Platform Terms

Your use of the Platform is subject to Meta’s (Instagram’s) Platform Terms and Developer Policies. You agree to comply with all applicable Meta/Instagram terms. KDC accesses Instagram data solely through official, authorized APIs and does not circumvent any platform restrictions.

5. Acceptable Use

You agree not to:

  • Use the Platform to send spam, unsolicited messages, or bulk automated communications in violation of Instagram’s policies
  • Use automation flows to harass, deceive, or engage in fraudulent activity
  • Upload, publish, or transmit content that is unlawful, defamatory, obscene, or infringes on any third party’s rights
  • Attempt to reverse-engineer, exploit, or compromise the Platform’s security
  • Exceed the usage limits associated with your plan
  • Use the Platform in any manner that violates applicable laws or regulations

6. Plans and Service Limits

Access to certain features is governed by the plan assigned to your site. Plan limits (number of connected accounts, automation flows, sync frequency, etc.) are enforced by the Platform. KDC reserves the right to modify plan offerings, features, and pricing with reasonable notice.

7. User Content and Data

You retain ownership of all content you create, upload, or sync through the Platform. By using the Platform, you grant KDC a limited license to store, process, and display your content solely for the purpose of providing the Platform’s services.

8. Content Indemnification

KDC Tek Pvt. Ltd. does not create, curate, moderate, endorse, or assume any responsibility whatsoever for the content on your site. All Instagram media, comments, direct messages, automation responses, published posts, product listings, and any other content managed through or displayed on the Platform originates from you or your connected Instagram account(s).

You agree to indemnify, defend, and hold harmless KDC Tek Pvt. Ltd., its directors, officers, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

  • Content you create, sync, publish, or distribute through the Platform
  • Your use of automation flows, including any messages sent or actions taken automatically on your behalf
  • Any intellectual property infringement, defamation, or violation of third-party rights resulting from your content
  • Your violation of these Terms, Instagram/Meta’s policies, or applicable law

This indemnification obligation survives termination of your account and these Terms.

9. Limitation of Liability

To the maximum extent permitted by law, KDC Tek Pvt. Ltd. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, data, or business opportunities, arising from your use of the Platform. Our total liability for any claim shall not exceed the amount you paid to KDC in the twelve (12) months preceding the claim.

10. Service Availability

We strive to keep the Platform available and operational but do not guarantee uninterrupted access. The Platform depends on third-party services including Instagram’s Graph API, and service disruptions may occur beyond our control. We are not liable for downtime caused by Instagram API changes, Meta platform outages, or other external factors.

11. Termination

Either party may terminate the relationship at any time. You may disconnect your Instagram account and request deletion of your site and data. KDC reserves the right to suspend or terminate accounts that violate these Terms, with or without notice. Upon termination, your data will be permanently deleted in accordance with our Privacy Policy.

12. Modifications to Terms

We may update these Terms from time to time. Material changes will be communicated through the Platform or via email. Continued use of the Platform after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in the jurisdiction where KDC Tek Pvt. Ltd. is registered.
